Terms of Service

1. Agreement and definitions
By accessing or using flirque.com and the Flirque service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms should be read together with our Privacy Policy, which explains how we handle personal data.
Key terms:
- Creator — a content creator who uses Flirque to manage their direct messages.
- Fan — an individual who sends messages to a creator on a platform where Flirque operates.
- Platform — a third-party service where creators and fans interact (e.g. OnlyFans, Fansly).
- Service — the Flirque AI messaging system, creator dashboard, and related tools.
- AI System — the artificial intelligence that generates and sends messages on your behalf.
2. The Service
Flirque provides AI-powered direct message management for adult content creators. Our AI System reads incoming fan messages, generates responses in your voice and persona, and sends them through your connected platform account.
What the Service includes
- 24/7 automated responses to fan direct messages on your connected platform(s)
- AI persona trained on your voice, personality, and communication style
- Fan profile management — the AI builds and maintains context about each fan to personalise conversations
- Revenue optimisation — contextual content recommendations and pay-per-view suggestions based on conversation flow
- Creator dashboard for analytics, performance review, and settings management
- Safety monitoring with automated content moderation and escalation alerts
What the Service does not include
- Content creation (photos, videos, or other media) — you provide your own content catalogue
- Platform account management beyond direct messages (posting, profile edits, billing)
- Legal, tax, or financial advice
- Guaranteed revenue outcomes — while the AI is designed to increase engagement, results vary based on factors outside our control
You understand and agree that messages sent by the AI System are sent on your behalf and under your responsibility. You retain full control to override, edit, pause, or disable AI responses at any time through the dashboard.
3. Eligibility
To use the Service, you must:
- Be at least 18 years old
- Be the authorised account holder on the platform(s) you connect to Flirque
- Have the legal right to grant Flirque access to send and receive messages on your behalf
- Be legally permitted to operate an adult content creator account in your jurisdiction
- Comply with the terms of service of every connected platform
We reserve the right to verify your identity and eligibility at any time. Providing false information during application or onboarding is grounds for immediate termination.
4. Account registration and security
Your credentials
You are responsible for maintaining the confidentiality of your Flirque login credentials and any platform API keys or access tokens you provide to us. You must notify us immediately at hello@flirque.com if you suspect unauthorised access to your Flirque account or if your platform credentials are compromised.
Platform access
To operate the Service, you grant Flirque permission to access your platform account(s) for the sole purpose of reading and sending direct messages, accessing conversation history, and retrieving transaction data relevant to messaging. We will not access other areas of your platform account (posts, profile settings, banking details) unless explicitly agreed.
Credential storage
Platform API keys and access tokens are stored encrypted (AES-256) on our servers. We follow industry-standard security practices as detailed in our Privacy Policy. We are not liable for losses arising from unauthorised use of your account where you have failed to maintain credential security on your end.
5. Onboarding
Before the AI System begins responding on your behalf, you will complete an onboarding process that includes:
- Voice and video samples — recordings that capture your communication style, tone, and personality. These are used solely to configure the AI's voice for your account.
- Persona configuration — details about your personality, interests, boundaries, and conversation preferences that guide the AI's behaviour.
- Content catalogue — metadata about your existing content (descriptions, categories, pricing) so the AI can make relevant recommendations. We analyse descriptions and metadata only — we do not store your actual media files.
- Platform connection — linking your platform account(s) so the AI can access your direct messages.
Review period
New creator accounts enter a review period during which AI responses are monitored more closely before being sent. The length of this period depends on message volume and quality metrics. During this period, response times may be slightly longer as messages pass through additional review. You will be notified when the review period ends.
6. Creator obligations
As a creator using Flirque, you agree to:
Accuracy and maintenance
- Provide accurate and truthful information during onboarding
- Keep your persona configuration, content catalogue, and platform credentials up to date
- Notify us promptly if your platform account is suspended, restricted, or closed
Oversight and review
- Review AI performance regularly through the dashboard
- Respond to safety escalations and flagged conversations in a timely manner
- Report quality issues, AI errors, or fan complaints through the appropriate dashboard channels
Legal compliance
- Comply with all applicable laws in your jurisdiction, including those related to adult content, consumer protection, and data privacy
- Comply with the terms of service of every platform connected to your Flirque account
- Ensure your content catalogue does not contain illegal material
- Maintain any required age verification, record-keeping, or licensing obligations applicable to adult content creators in your jurisdiction
7. Prohibited uses
You may not use the Service to:
- Send, distribute, or facilitate the distribution of content depicting minors in any context
- Send non-consensual intimate content or facilitate harassment, stalking, or threats
- Impersonate another creator or real person without authorisation
- Engage in fraud, scams, or deliberately deceptive practices designed to extract money under false pretences
- Attempt to reverse-engineer, extract, or replicate Flirque's AI system prompts, training data, or proprietary methods
- Share Flirque system details, AI configurations, or proprietary technology with competitors or third parties
- Use the Service to violate any applicable law or the terms of any connected platform
- Interfere with or disrupt the Service, its infrastructure, or other creators' accounts
- Use automated tools to interact with the Flirque dashboard or APIs outside of their intended purpose
Violation of any prohibited use is grounds for immediate suspension or termination without notice.
8. AI limitations and disclaimers
The AI System is a tool that generates messages based on patterns, context, and your persona configuration. You acknowledge that:
- The AI can make mistakes — it may occasionally produce responses that are inaccurate, off-brand, or inconsistent with previous conversations. We continuously improve quality but do not guarantee error-free output.
- The AI may fabricate details — like all large language models, the AI can generate plausible-sounding information that is not factually true. It may invent personal anecdotes, reference non-existent content, or confuse details between conversations.
- Quality varies — response quality depends on the richness of your persona configuration, the nature of fan messages, and the current state of our AI models. Some conversation types are handled better than others.
- The AI is not a substitute for human judgement — for sensitive situations (fan distress, legal requests, safety concerns), the AI will escalate to you or flag the conversation. You should not rely solely on the AI for situations requiring human empathy or legal awareness.
The AI System is provided “as is” with respect to response quality. We make no warranty that the AI will meet specific revenue targets, achieve particular engagement rates, or produce responses indistinguishable from your own.
9. Content and intellectual property
Your content
You retain full ownership of your persona, voice and video samples, content catalogue, and all original material you provide. You grant Flirque a limited, non-exclusive, revocable licence to use this content solely for operating the Service on your behalf. This licence terminates when your account is closed, and we will delete your persona data in accordance with our Privacy Policy.
AI-generated messages
Messages generated by the AI System are created on your behalf. Once sent, they are your responsibility. Flirque retains no ownership claim over sent messages. We may retain copies of sent messages for quality analysis and service improvement, as described in our Privacy Policy.
Flirque intellectual property
The Flirque platform, AI System, algorithms, system prompts, training methodologies, dashboard, and all associated technology are the intellectual property of Flirque. Nothing in these Terms grants you any rights to our underlying technology beyond the right to use the Service as described.
10. Data processing roles
When the AI System processes fan conversations on your behalf:
- You are the data controller — you determine the purposes of messaging fans and are responsible for any obligations that flow from that role under applicable data protection law
- Flirque is the data processor — we process fan data on your behalf and according to your instructions (as expressed through your persona configuration and service settings)
We maintain appropriate technical and organisational measures to protect fan data processed on your behalf. Fan data is strictly isolated per creator — we never share fan data between different creators or use it for purposes beyond operating your account.
If a fan exercises a data protection right (access, deletion, objection), we will notify you and cooperate to fulfil the request. See our Privacy Policy for details on fan rights.
11. Safety and moderation
Flirque operates several safety systems to protect creators, fans, and the integrity of the Service:
- Content moderation — AI-generated messages pass through quality and safety checks before being sent. Messages that violate safety rules are blocked or flagged for your review.
- Escalation alerts — conversations involving fan distress, legal requests, age-related concerns, or other sensitive topics are flagged and may be paused pending your review.
- Automatic safeguards — the system includes rate limiting, circuit breakers, and automatic pauses that activate if unusual patterns are detected (e.g. abnormally high message volumes, repeated errors, or potential account compromise).
- Review queue — during your review period and in certain flagged scenarios, messages enter a review queue before being sent.
You agree to respond to safety escalations promptly. Repeated failure to address flagged conversations may result in temporary pausing of the AI System on your account.
12. Pricing and payment
Fees
Service fees are based on the pricing tier agreed during onboarding. Your specific pricing, billing cycle, and payment terms are set out in your onboarding agreement. If no separate agreement exists, the pricing published on flirque.com at the time of your sign-up applies.
Changes to pricing
We reserve the right to adjust pricing. Any price increase will be communicated to you in writing at least 30 days before it takes effect. If you do not accept the new pricing, you may terminate your account before the change takes effect without penalty.
Late payment
If payment is not received within 14 days of the due date, we may suspend the AI System on your account until the balance is settled. Accounts with outstanding balances exceeding 30 days may be terminated.
Refunds
Refunds are considered on a case-by-case basis. Service fees for periods where the AI System was operational are generally non-refundable. If the Service was materially unavailable due to an issue on our end, we will provide a pro-rata credit for the affected period.
13. Confidentiality
Our obligations
We will treat your persona configuration, voice samples, fan data, revenue information, and all non-public account details as confidential. We will not disclose this information to third parties except as described in our Privacy Policy or as required by law.
Your obligations
You agree to treat Flirque's proprietary technology, system prompts, AI methodologies, and internal processes as confidential. You may not share, publish, or disclose details of how the AI System works to competitors, third-party agencies, or the public. You may publicly state that you use Flirque for DM management, but not disclose implementation details.
These confidentiality obligations survive termination of your account.
14. Service availability and force majeure
Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Unscheduled downtime may occur due to infrastructure issues, security incidents, or urgent fixes.
Platform dependencies
The Service depends on third-party platform APIs (OnlyFans, Fansly, etc.) and AI inference providers. Changes to these external services — including API deprecations, rate limit changes, terms of service updates, or outages — may affect the Service. We are not liable for disruptions caused by third-party platform changes, but we will work to restore functionality as quickly as possible.
Force majeure
Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, government actions, internet outages, cyberattacks, pandemics, or third-party service failures. If a force majeure event prevents service delivery for more than 30 consecutive days, either party may terminate without penalty.
15. Limitation of liability
To the maximum extent permitted by applicable law:
- Flirque is not liable for revenue lost due to AI response quality, system downtime, or platform changes
- Flirque is not liable for actions taken by connected platforms against your account (suspensions, restrictions, policy enforcement)
- Flirque is not liable for fan reactions to AI-generated messages, including complaints, chargebacks, or public statements
- Flirque is not liable for content fabricated by the AI System (invented anecdotes, non-existent content references, factual errors)
- Flirque is not liable for indirect, incidental, special, or consequential damages of any kind, including loss of profits, data, or reputation
Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total fees you paid to Flirque in the 3 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or personal injury caused by negligence.
16. Indemnification
You agree to indemnify, defend, and hold harmless Flirque and its officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Messages sent on your behalf by the AI System
- Your content, persona configuration, or media catalogue
- Your violation of these Terms, applicable law, or any platform terms of service
- Claims by fans or third parties arising from AI-generated messages sent under your account
17. Suspension and termination
Termination by you
You may terminate your account at any time with 14 days written notice to hello@flirque.com. The AI System will be disabled immediately upon request (or at the end of your notice period, at your choice). Any outstanding fees remain payable.
Termination by Flirque
We may terminate your account with 14 days written notice for any reason. We may suspend or terminate immediately and without notice if:
- You violate these Terms, particularly the prohibited uses in Section 7
- Your platform account is permanently suspended or closed
- Your conduct poses a risk to other creators, fans, or the integrity of the Service
- We are required to do so by law or a platform's terms of service
Effect of termination
Upon termination:
- The AI System stops sending messages on your behalf immediately
- Your access to the dashboard is revoked
- Your data is handled in accordance with the retention schedule in our Privacy Policy
- Sections that by their nature should survive (confidentiality, indemnification, limitation of liability, governing law) continue in effect
18. Dispute resolution
If a dispute arises between you and Flirque, we encourage resolution through the following process:
- Direct communication — contact us at hello@flirque.com with a clear description of the issue. We will respond within 14 days.
- Mediation — if direct communication does not resolve the dispute within 30 days, either party may propose mediation through a mutually agreed mediator.
- Litigation — if mediation fails or is not pursued, disputes will be resolved through binding arbitration or in a court of competent jurisdiction, as set out in Section 21.
Nothing in this section prevents either party from seeking urgent injunctive relief where there is a genuine risk of irreparable harm.
19. Changes to these Terms
We may update these Terms to reflect changes in our service, legal requirements, or business practices. When we make material changes:
- We will notify you by email at least 14 days before changes take effect
- We will update the “Last updated” date at the top of this page
- We will provide a summary of what changed
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your account before they take effect.
20. General provisions
- Entire agreement — these Terms, together with the Privacy Policy and any separate onboarding agreement, constitute the entire agreement between you and Flirque regarding the Service.
- Severability — if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
- No waiver — our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it later.
- Assignment — you may not assign or transfer your account or any rights under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
- Independent contractor — Flirque is an independent service provider. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Flirque.
- Notices — notices to Flirque should be sent to hello@flirque.com. Notices to you will be sent to the email address associated with your account.
21. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes not resolved through the process in Section 18 shall be submitted to binding arbitration or resolved in a court of competent jurisdiction agreed upon by both parties.
